and it certainly does feel like it. it is very cold and clear out here this morning. and over the weekend a lot of people figured what the heck. a good time to ice skate. why not. you are dressed for those below freezing temperatures. >> right now my toes are cold and tingling and i'm not sure i even have toes. >> reporter: now, that frost we have seen is threatening citrus crops across the state though a spokesperson for the citrus industry says that most should survive. the mandarin oranges are more vulnerable than the rest. one bing cherry grower in sunnyvale says crops have a chilling requirement so they are optimistic about the weather. over the weekend you may have had frost on the car windows but we haven't seen that this morning. reporting live in walnut creek, christie smith, "today in the bay."

firefighters say all that cold stuff out there may be indirectly responsible for a house fire in east san jose. crews responding yesterday afternoon at 3:30 afternoon. saying the entire roof was on fire when they arrived. a total of six people who live in that home were able to get out safely. the cause of the fire right now under investigation. the people who live there say they had a fire going in the fireplace when the bigger fire broke out. fire crews still on the scene of an overnight house fire in berkeley. the call came in around midnight at 2309 action street. the building is a single story five-plex. one person reported suffering minor burns and smoke inhalation and was transferred to st. francis memoriamemorial. the fire is still under investigation. police in santa cruz searching for a man they say assaulted a 12-year-old girl.

he grabbed the girls buttocks when she was walking home from school when he approached her from behind and groped her. the suspect was last seen running upstairs leading to groverland and town terrace. anyone that recognizes this man is asked to contact the santa cruz police department. homicide rates on the rise across the bay area. new data from the department of justice shows 15 biggest cities in the region have 310 murder cases last year. most of those numbers come from san francisco, oakland and san jose where murder rates increased by more than 52% in just the last two years. overall major violent crime went up 23% in both oakland and san jose. san francisco only saw a slight increase from the year before. investigators at this hour trying to figure out what triggered a partial evacuation of a san jose hotel. more than a dozen people at the hilton hotel in downtown san jose ended up sick yesterday

morning. hazmat crews arrived just before 11:00 a.m. 13 people there were treated at the scene after complaining of irritation in their throat and in their eyes. investigators think they were exposed to some kind of chemical but at this point they're not sure what that substance may be. relief this morning for commuters heading out to the dumbarton bridge. a toll lane shut down due to budget trouble is finally reopen. bob redell is live near the dumbarton bridge about why officials are making that move. >> reporter: because of the backup. it was so big starting at the beginning of the year. it got worse even last week as more people came off holiday and started going back to work. what happened is the dumbarton bridge shut down lane number four which you can see is still closed right now. normally it would be open. at the beginning of the year they shut it down. they stopped manning it to save some money. the backup was so bad we had

reports of the backup extending all of the way to 880 which if you are familiar with the approach to the bdumbarton bridge, that's quite a distance. they came to an evaluation that we need to re-man that but they'll do that around the commute hours when it is most important. 7:00 to 9:00, 7:00 to 10:00 range. that number four lane by the time you hit the road and you start seeing things start to back up, that's supposed to be back only starting today. the possibility exists that maybe they would convert this to a fastrak only lane so no longer housed but it would be open and manned with or have the fastrak sensors on. one reason why they did do the budget cut or they tried to de-man it is to get people to convert to fastrak. reporting live at the dumbarton bridge, "today in the bay." going from action on dumbarton, let's check in with mike inouye to see what's happening on your commute. good morning. >> hopefully it will bring

relief for the dumbarton. clear right there. we're looking to the san mateo bridge. its neighbor to the north. more heavily traveled right now. westbound with taillights away from us over the high rise and to the peninsula. a clear, chilly drive. over on the peninsula side we'll take over with our maps and we're looking at 92 between 101 and 280. speeds down around 60 miles an hour. a light flow of traffic. our average is liberal there. trust me. no incidents there. no slowing between the two freeways. over the san mateo hills, 92 snakes its way past the pumpkin farms or christmas tree farms or whatever they are growing right now for the season. a smooth drive. other than that a report of black ice east 92 heading out of half moon bay past skyline reports of black ice on the freeway blocking your two eastbound lanes. be careful there. we'll check that out more closely with a crew over the next two minutes. across the bay, just fine.

so is golden gate bridge. south bay moves smoothly here. we're not machines. you'll tell us how we're feeling today. >> that's a cold hearted camera if i ever seen one. 39 degrees in napa. 38 in san francisco. and mike is right. you want to be advised there's black ice out there. however, we're still dry. dry as a bone. you probably have been applying that chapstick over the course of the weekend because it's dry out there. we don't have a lot of frost or black ice to report at this time. travel cautiously because you could encounter a patchy area on the way to work. 34 in san jose. downright bone chilling cold at gilroy at 25 degrees. we're going to stay dry for most of the week. temperatures are going to climb. we've got one more frigid start to get through with temperatures in the low to mid 20s in coldest cities. we'll see a three to five-degree warmup in both your lows and highs tomorrow it still staying on the cool side. a major warmup on the way. i think you'll be delighted with

weather. it's 5:11. the massachusetts institute of technology says it will launch an investigation into the role into the prosecution of an internet activist found dead over the weekend. scott mcgrew says the death has been called a suicide but m.i.t. wants to know what role it may have played. >> schwartz was a very young and well regarded computer programmer. invented the rss system. he also was accused of breaking into a closet at m.i.t. and hooking up a laptop into the school's computer system to download millions of academic studies and papers. the u.s. attorney's office brought charges. schwartz faced decades in prison. despite the fact the publisher of the academic articles actually opposed the charges. m.i.t. this morning issued a letter to students and faculty saying it would look at its own behavior but came to the conclusion right in the letter itself that the school did not speak up against the prosecution

loudly enough. the u.s. attorney's office blames schwartz for millions of dollars worth of academic papers stol even though many of those papers were available completely for free. in happier news this morning, looks like markets will start monday well. let's turn to seema mody live at cnbc world headquarters. good morning, seema. >> good morning. futures pointing to a green open. asian markets mostly higher overnight and european markets seeing green across the screen. the dow gained 17 points on friday and the nasdaq added nearly four points to close at 3125. all eyes on tech earnings this week with ebay kicking off results on wednesday followed by intel on thursday. analysts say major tech companies could miss estimates for the fourth quarter. worries about the fiscal cliff may have led companies to hold back from spending. tech earnings in focus this week. scott, back to you. >> seema, thank you. 5:12. the white house over the weekend

said it will not move forward with the construction of a death star despite a petition signed by thousands of americans asking for one. the white house budget office listed the number of reasons. first being america does not support blowing up planets. also, we already have a space station. white house legally required to respond to any petition that gains 25,000 signatures. it also rejected petitions, no joke, over the weekend over state succession. said louisiana, texas, alabama, florida, have to stay in the union. >> happy to hear that. >> thank you. christina loren is here with good news. it's cold today but warmth is on the way. >> a good news/bad news scenario. light at the end of the tunnel. something to look forward to is how i'll present it. frigid yet again this morning. look at this. one of the coldest cities we're watching, walnut creek at 28 degrees. and stick around. christie smith is live to show

you how 28 degrees impacts the human condition. we're going to get to her report in just a minute. she's bundled up. do the same before heading out the front door this morning. we'll get to her report in just a minute. temperatures will keep dropping off throughout the morning hours. it's already cold out there. 32 degrees right now in novato. 39 in napa. 38 degrees in san francisco. so freeze warning in san francisco. just san francisco has been canceled. we do have one in place until 9:00 a.m. for interior valleys of the northeast and south bay and for good reason. look at gilroy at 25 degrees. just a chilly start to the day. take in those sensitive plants and pets. won't have to do so every morning this week. a warmup on the way. for next couple days the jet stream stays to the south and cold air will funnel in all day long today and tomorrow as well. under abundant sunshine. 51 in livermore today. chilly tuesday into wednesday. back at the mid 60s friday into the upcoming weekend. a little black ice out there. travel cautiously. here's mike to help you out.

>> be careful. san mateo hills is the one area where you have the report but christina has been talking about colder temperatures throughout the bay again. drier for the atmosphere. probably not so much black ice. if you have a busted sprinkler out there along the freeway or roadway, that could be an issue as well. we're tracking that. meanwhile the commute itself a little slow right now. a little light. slow means slow. any way, we're looking at 880 here. only activity for san jose. the alameda onramp that's highway 82 or actually el camino further north. onramp to northbound 880 is blocked by a road crew until 7:00 a.m. you have to use the other alternate onramps to that portion through san jose. the southbound side has construction going on between coleman and baskum. there's slowing because of the sensors reading equipment in the area but overall light volume of traffic. not a big deal for the south bay itself. as you get down here or heading

through the east bay. a nice easy flow of traffic in commute directions through this area. and we'll look at 880 through oakland with volume of traffic which is starting to kick up just a tiny bit in the northbound direction. right here the curve and high street overpass not a big deal. bottlenecking as you come southbound as well around the same area. again, crews are clear from here. it's southbound between 16th and fruitdale where you have crews hanging out. keep that in mind for the oakland area. a pickup of volume at the bay bridge toll plaza. no problems for east shore freeway west 80 is your commute direction. we'll look at the peninsula with palo alto. an easy drive northbound. this is willow off-ramp here and southbound side toward university. smooth flow here as well as through the city again. peninsula the only issue is black ice reported at highway 92 and skyline. be careful heading over the hills. back to you. >> thanks.

"argo" beat out "lincoln" and "zero dark 30.30." ben affleck picked up a win for best political director days after being snubbed for an academy award nomination. >> i don't care what the award is. when they put your name next to the names that she just read off, it's an extraordinary thing. >> jessica won best actress for "zero dark 30." best actor to daniel day-lewis in "lincoln." three big wins for "les miserables." in tv "homeland" won big and a first-time best actor win for damione lewis.

what's an award show without throwing out the red carpet? >> you have to do it. red on red on red this year. globe winner and new mom in red. another globe winner julianne moore making a fashion statement with black and white and nicole kidman in a down from alexander mcqueen. and supporting actress winner anne hathaway was in chanel. halle berry looks good in everything. this is a one shoulder gown that sparked fashion debate believe it or not. as did the sea foam green gown from calvin klein. little to say by fashion critics. >> one of the best red carpets i have ever seen. >> one of the best they've ever

seen. jennifer lopez's sheer gown grabbed attention as did this one. fans looking for major misfires may have been a little disappointed. >> a round of applause to the ladies. nicely done. 5:19. first look at the torches for the 2014 winter olympic games. we can tell you the shape resembled a feather from a fire bird which is a character from russian fairy tales. it's colored red to match the shade used in traditional russian sports. pretty cool. the torch is made of a very light weight aluminum. the torch relay starts this october in greece ending in february 2014 in russia. we'll watch for it. 5:19. coming up, keeping an eye on the hillside. a popular landslide threatening the berkeley national lab. details next. live picture for you spanning over san jose. christina loren is telling us still very cold.

welcome back, everyone. a live look at our nation's capital this morning. old glory flying in the breeze. starting to prepare for the president's inauguration coming up in about a week. we'll of course have continuing coverage of all of the happenings in d.c. a potential landslide threatening the lawrence berkeley national laboratory campus. rain over the past few months have caused one hillside to inch closer to a roadway. the building which lays in the path has been closed down as a precaution. workers are using pumps to remove water from the slide area while scientists are trying to look for a long-term fix.

good news for hockey fans out there. after a long lockout and knockout punches on both sides, san jose sharks starting practice. hundreds of happy fans greeting players yesterday afternoon at shark ice in san jose. sharks are forced to have a shortened training camp and season before everything gets started. here are dates you need to know. game one of the 48-game season will be sunday in cal ggarcalga. first home game january 24th against phoenix. nhl season ends on april 27 this year. the sharks will be in l.a. that day. the playoffs will start april 30 with stanley cup final happening at the end of june. >> enough ice around the bay area to play hockey this morning. check the forecast now with meteorologist christina loren. >> good morning to you. want to give yourself plenty of time to reach your destination safely with temperatures dropping off as we speak. not yet in that record low potential territory. we will likely get there in some cities as we progress throughout

the next couple hours. a live look at a crystal clear start over san francisco where the freeze warning has been able to expire because temperatures are downright mild compared to yesterday morning. running five to ten degrees colder in some cities than just 24 hours ago. so 25 degrees in gilroy today. to start out we'll see temperatures cold in upper 30s by noon and then we'll round out the day in upper 40s and low 50s. if you want a warmer day, if you are looking for sunshine that actually represents 60, 65 degrees, we've got that for you. just 72 hours away now. close to 70 degrees to finish off the week and so the temperatures are going to keep on climbing. that's good news. have to get through the cold morning first. and possibility of black ice not as great as yesterday morning because we're drier out there. it's still a factor. let's check on the drive and everything else you need to worry about with mike inouye. >> because of temperatures black ice is a possibility. even though it's not a lot of moisture in the air and a busted sprinkler or something else

causing water to be on the roadway will freeze because of the temperatures. watching the peninsula for only report 92 at 35. 880 smoothly past the coliseum. we do have two incidents. stalled big rig south of 980 and a crash now between big rig and car. initial reports there around 23rd. lane information we don't see any slowing over the last couple of minutes but this just happened a couple minutes ago. we'll track that as you head south out of downtown oakland and over toward the coliseum. meanwhile the rest of your area for 580 moves smoothly for your commute. typical build as expected coming out of the altamont pass with speeds into the 40s and into livermore into the 50s but that build is starting to happen right now into livermore and pleasanton. back to you. >> it's not unusual to see hundreds of people riding public transportation on the weekend. but it is unusual to see hundreds of people wearing no pants. the event --

forecast coming up. freezing inside too. first, let's take a look at your first paycheck of 2013. it is certainly taking a lot of people by surprise. a few dollars less in their check than they expected. maybe more than a few. scott mcgrew explains why we can blame it on the fiscal cliff. good morning. >> good morning to you, laura. the expiration of the payroll tax holiday is really to blame. as we first reported when congress failed to solve the fiscal cliff kicking it down the road, your social security tax went up. even as you kept the benefit from the bush tax cuts. now, if you were surprised by that, blame us in the media because looking back on it, we kind of took a shortcut we shouldn't have and that is we reported the average tax break under that bush tax cut was $1,000 or more. it's more money you would lose to higher payroll taxes. the problem was that $1,000

average was true but lousy way of expressing that. the rich got an enormous tax break and that skewed the average. put another way, well, put another way, it's not the money you were expecting. i'll explain more about it coming up in just a bit. back to you. >> all right. thank you very much. it's 5:31 right now. the hot water we can tell you still off this morning for hundreds of seniors in a san jose apartment complex. residents of the town park towers on third street have been without hot water for more than a week. most are elderly or disabled. they say they've had problems getting hot water since december 3rd. some tenants say they have caught warm water every once in a while but it does not even stay on long enough for a quick hot shower. >> i don't like it. it's not a healthy thing to be doing. even washing dishes in cold water, you're not getting rid of bacteria. >> a representative for that complex says there's been problems with their solar heating system and a replacement

boiler system is providing hot water right now. but residents we talked to say the water is still cold. meantime, in the east bay, temperatures right now hovering around freezing all morning long. >> temperatures well below the freezing point overnight and this morning people are doing whatever they can to try to stay warm including "today in the bay's" christie smith live in the east bay where temperatures are hovering around the freezing mark we understand there. >> reporter: that's exactly right. i didn't forget my gloves this morning. it's a little bit deceiving out here because when you drive around you notice that the windshields aren't frosted over, the roofs and white, bushes that might have been frosted before and frosty white are not like that this morning. make no mistake. it's cold out here this morning. you will feel it as soon as you step out of the house. i want to show you what this bank sign looks like this morning here in downtown walnut creek. when we first arrived it was showing us 28 degrees. now it's about 31 degrees. and the below freezing

temperatures and frost are threatening some citrus crops across the state in central valley areas. farmers are very hopeful that they can avoid crop damage. a spokesperson for the citrus growers industry says most oranges and lemons should be okay but the mandarin orange crop is more vulnerable but a growing of bing cherries says the cold snap has an upside because some fruits have a chilling requirement. >> optimistic that the fruit will set, bloom and produce. no guarantee but that's the consensus so far. >> reporter: and then there are those that say what the heck why not go with it. you're already dressed for it. bundled up. ice skating in downtown walnut creek. that's officially the rink closed now for the season. reporting live in downtown walnut creek, christie smith, "today in the bay." >> all right. she's bundled and warm out there. that's the ticket for this morning.

>> absolutely. let's check in with christina loren to find out. just cold. just makes you feel like you can't talk. >> even this tough guy is cold. >> come on. he's putting up a front. we know how tough jon kelley is in his puffy coat. 28 degrees and slippery conditions where christie is in downtown walnut creek it's more mild than where our thermometer is located in walnut creek. 34 degrees in san jose. 25 degrees in gilroy. the only place colder than walnut creek right now is old gilroy. make sure you bundle up out there. 37 in san mateo. in addition to the cold conditions, you have a wind at 18 miles per hour in fairfield. there is definitely a windchill factor and as we factor in that wind, feels like 28 degrees in fairfield. much colder than the true temperature. 35 in livermore. 34 degrees is the true

feels-like temperature in san jose this morning. as those winds continue to whip, it will continue to feel cold out there. what happens is that wind keeps the frost from settling in and really developing even though it's dry out there, that wind will keep the frost from settling in. so temperatures are running more mild than this time yesterday in some cities. we'll end up in the 50s yet again and another cold afternoon. this is our last afternoon in the low 50s. the mid 60s return in just days. a rapid warmup on the way. we'll detail that in my seven-day forecast. let's check the drive. >> good morning. you talk about having the background in agriculture like my family does. you turn on fans from the frost happening. that's what you talk about moving air around. we are moving traffic through the cold air. we have a smooth drive west 80 down through berkeley and emeryville. a smooth flow of traffic but you get more company over the last few minutes. we'll expect it to continue to build heading down to the bay bridge toll plaza where the view looks like this. the cars are starting to slow a bit as you approach the toll

plaza. the cash lanes now showing a few cars as far as build up goes. fastrak an advantage for 20 to 30 minutes. we're watching typical monday pattern for this area. on maps we'll look at flow of traffic off the san mateo bridge which is just fine over on the hayward toll plaza. speeds sticking around 60 miles an hour. yellow tipping point through the san mateo hills heading over between 101 and 280. while we did have reports of black ice, that was christina was alluding to 92 at highway 35. we have one of our photographers who went out there. she checked things out. the drive is okay. she didn't see anything visible. of course black ice would blend in with the pavement and not the best way to test it is driving over it. we did have erin do that. it's safe for everyone coming over the hill. it's okay now. be careful over the san mateo hills because there was at least one report. palo alto a smooth drive for 101. just south of willow avenue. you see taillights toward that exit. that's south of the dumbarton bridge as well. coming over from the dumbarton bridge on the eastern side, the

toll plaza had a big backup last week. bob redell is out there now. there's changes in place this week. what do you have as far as that update and what commute is expected this morning? >> reporter: the good news -- good morning to you, mike. the toll lane number four which you can see is shut down behind me will be reopened at the start of the year the dumbarton bridge defunded the person who was in there. in other words they stopped manning that toll booth because of budget reasons. over the past couple of weeks they have seen a tremendous backup. sometimes going all of the way to 880. they did a reevaluation and over the weekend they decided during the commute we're talking about 7:00 to 10:00 in the morning they are going to have the number four toll booth back open. we expect within the next hour and a half for that to be reopened. one reason why the bridge did cut back on funding this is they're trying to encourage more people to go to fastrak. of course that's electronic toll device that you have in your car

that automatically takes away money from your account so you can cross the bridge. it's quite possible that maybe in the future that number four lane would just be fastrak only lane since technology is there. for the time being right now they'll put a toll taker back in there for the morning commute. if you are heading from the east bay over to the peninsula via dumbarton bridge and you are in those massive backups last week, the good news is you should not have that problem this morning. reporting live at dumbo, bob redell, "today in the bay." another new problem with boeing's dreamliner forces an airline right now to ground one of its 787s. we'll let you know what went wrong next. our golden globe highlights continue including a surprise appearance at last night's award show.

welcome back, everyone. good monday morning to you. it's 5:41. big busy week for washington lawmakers. they have to deal with debate over gun control. confirmation hearings and the debt ceiling. "today in the bay's" tracie potts live in capitol hill where they are also getting ready for the president's inauguration coming up. good morning, tracie. >> all of that in the middle of planning a big party. 600,000, 800,000 people expected here. behind the scenes congress does have a number of things to deal with. will they pass an assault weapons ban? the nra doesn't think so. the white house is still expected to push for that. today vice president biden sits down with lawmakers and his task force and cabinet members to finalize recommendations for tomorrow. he wants to put them on the president's desk tomorrow. you mentioned the senate confirmation hearings. defense secretary nominee chuck hagel still has some lawmakers, democrats and republicans scratching their heads. lots of questions on iran and israel for him as those hearings come up and then finally the

debt ceiling. we pushed it off. we hit it in december. didn't pay a few bills to push that off until february. now as the house resumes today, congress must make some decisions. republicans will push for more spending cuts. this time we're told including social security. so a big agenda this week. >> all right. we'll see how it goes. thank you very much, tracie. new this morning, japan airlines has grounded one of its boeing 787 dreamliners. the airline says it found a fuel leak during an inspection outside of tokyo yesterday. it is reportedly the same aircraft that had a fuel leak in boston last week. now it is the latest trouble surrounding the boeing 787. friday the u.s. government launched an investigation into the recent problems with that plane. after spending more than a month in the hospital, former president george h.w. bush may get to leave as early as today. bush's son, former florida governor jeb bush, said his

teenage girls in oakland are expected to answer to charges today. powell and edwards are set to e enter those pleas this afternoon in shooting death of bobbie sartain and raquel gerstel. powell is charged with two counts of murder. edwards charged with being an accessory after the fact. a runway at sfo shut down this morning. crews there spent the weekend working on the runway. expected to wrap things up around 8:00 this morning. work delaying arriving flights last night for about 45 minutes. more delays are expected this month. there are two more weekend closures scheduled for january. the giants world series trophy continues its tour today with a stop in the east bay. fans will get an up close look at the trophy from 3:00 to 5:00 at the richmond memorial auditorium. the tour kicked off last week in
